- Subscriptions auto-renew unless canceled before the next billing cycle.
- No refunds are provided for unused time after cancellation.
- Chargebacks and payment disputes may result in account suspension.
3. Acceptable Use Policy
You agree to use our service responsibly and not to engage in any illegal or abusive activities, including:
- No fraudulent, illegal, or unauthorized use.
- No reselling, reverse-engineering, or tampering with our widget.
- No posting harmful content or attempting to disrupt service.
4. Disclaimer & Limitation of Liability
Our accessibility widget does not guarantee full ADA compliance. While it improves accessibility, it is ultimately the website owner’s responsibility to ensure compliance with applicable laws and regulations, including the Americans with Disabilities Act (ADA), Section 508, and WCAG 2.1 Level AA standards.
We are not liable for any legal actions, damages, or losses resulting from the use of our platform. Our service is provided "as-is" without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, special, or consequential damages arising from the use of our services.
5. Limited Protection Plan
We offer a limited protection plan that covers up to $10,000 worth of development work for accessibility-related adjustments if the user faces a legal claim concerning website accessibility.
- This coverage is strictly limited to minor development fixes, defined as front-end modifications such as changes to alt text, color contrast, ARIA labels, tab ordering, or HTML markup, and shall not exceed 10 total developer hours.
- To qualify, users must notify us in writing within 10 business days of receiving any legal notice or demand.
- This plan does not include legal fees, settlements, damages, or financial compensation of any kind.
- We do not provide legal representation or indemnification for any accessibility-related claims.
- Users acknowledge and agree that they are responsible for ensuring their website complies with all applicable accessibility standards.
- By using our service, you waive any claims against us beyond the stated development coverage.
6. Indemnification
You agree to indemnify, defend, and hold harmless our company, its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise from:
- Your use of our services.
- Your violation of these Terms of Service.
- Any accessibility compliance issues related to your website.
7. Termination of Service
We reserve the right to terminate accounts that violate these terms without prior notice. We also reserve the right to discontinue or modify our service at any time without liability.
